Our business name is HOFr Inc. (“HOFr”, “Company”, “we”, “us” and/or “our”). We are the owner of HOFr Payment Services LLC, the website www.hofr.io as well as the HOFr mobile application. Our services are designed to offer users (collectively, “Users,” “you,” or “your”) the opportunity to participate in fantasy contests (“Contest(s)”), or other content, products, services, and promotion (collectively “the Services”). The Services are provided to you through our mobile application (“App”).

HOFr takes your privacy seriously and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, store and protect your personal data, and informs you about your rights in regards to the processing of your personal data.

By using our Services, you acknowledge reading and consenting to the terms of this Privacy Policy. If you do not agree to the data collection, use, and sharing practices described in this Privacy Policy, you may not use our website or App. AS MORE CLEARLY DEFINED HEREIN, WE WILL NEVER KNOWINGLY SELL OR ASSIGN YOUR PERSONAL INFORMATION WITHOUT YOUR KNOWLEDGE AND/OR APPROVAL.

This Privacy Policy shall be read in conjunction with our Terms of Service.

Modifications to the Privacy Policy

We reserve the right to amend, modify or revise portions of this Privacy Policy at any time. If we do so, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. Any such changes will take effect from the moment they appear on our website and App. In the event we make material changes, we will notify you either through the Services user interface, in an email notification or through other reasonable means. Your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new Privacy Policy.

INFORMATION WE COLLECT

When you interact with our App, we collect information that, alone or in combination with other information, could be used to identify you (“Personal Data”). We only process your personal data to the extent that it is necessary and appropriate to the purposes for which it is collected. We make our best efforts to ensure that your personal data is secure, accurate and, where necessary, updated with regard to the purposes of the processing, taking all reasonable steps to delete, anonymize, or correct it in case of inaccuracy. It is your responsibility to update any and all personal identifiable information provided for use of our Services.

Information We Receive From Your Use of Our Services

When you use our Services, we may request your permission in order to track certain data about your visits to and usage of our Services to improve, customize, and optimize our Services, and comply with our legal obligations. The information (“log data'') is generated automatically by the App and automatically logged in our systems.

We may use this information to analyze trends, gather demographic information about our user base, promote our Services, perform research, provide technical and customer support, inform our product development efforts, comply with our legal obligations, address disputes, and prevent our Services from being used to commit harmful or unlawful activities, including fraud and money laundering. Some of this data may also be collected so that when you use the Services again, we will be able to recognize you and optimize your experience accordingly.

Log data

The log data includes your Internet Protocol (“IP”) address, browser type and settings, the date and time of your request, geolocation, and how you interacted with the Services.

Device information

The Device information includes the type of device you are using, operating system, settings, unique device identifiers, network information and other device-specific information. Information collected may depend on the type of device you use and its settings.

Usage Information

We collect information about how you use our Services, such as the types of content that you view or engage with, the features you use, the actions you take, your money movements (deposits and withdrawals), your winnings, frequency and duration of your activities.

HOW WE USE INFORMATION

We use your personal data for the following purposes:

To authenticate and communicate with Users, provide the Services, complete deposit and withdrawal transactions and transfer prizes.

Specifically, we use users’ email addresses and Face IDs to authenticate users and grant access to our services. We use Users’ device IDs to notify them when our Contests are available and are about to start or promote our Services. We use birthdates to ensure users are eligible to use the Services. If Users register using their social networking service User ID or connect with their social networking user ID, we use their profile photos to personalize account avatars and we use their social networking service friends lists to personalize Users’ leaderboards. We use users’ credit card information and PayPal ID to complete deposits and withdrawal transactions, and transfer any prize money to them. We retain records of deposits, withdrawals and prizes distributed for the purposes of operating the Services and fraud prevention. This processing is necessary to perform the contract with you. We also store prize winners’ full name, telephone number, mailing address, and, in some circumstances, social security or other government identification numbers so we can comply with our legal and taxation obligations.

To verify user location

Location coordinates are only gathered after the user has agreed to our Terms of Service and Privacy Policy. Users who deny location services will be ineligible to use our Services as verification of location and transaction origination from an eligible state is mandatory.

HOFr detects your device’s approximate location whenever it is turned on (subject to coverage limitations) and connected to our Services. Depending upon your type of device, HOFr may also be able to obtain a wide array of data points to the approximate location of your device. These data services, known as location-based services, are made available to HOFr and others, usually via applications that may be pre-loaded on your device, manually or automatically downloaded from various application stores.

We use information about your location to verify your device is located within an eligible location. If a user’s device is geo-located within a designated ineligible location, the login session may be terminated and contest entry and/or submission will be blocked. HOFr may provide location based-services or provide third parties with access to your approximate location, in order to provide our Services to you. When your device location is requested, you will be given the option to allow the service or deny it.

HOFr follows CTIA’s Best Practices Guidelines for location-based services.

SHARING AND DISCLOSURE OF INFORMATION

We may share or disclose your Personal Data with selected third parties at your direction, such as when you authorize a third-party service to access your account or when you voluntarily share information or content via the Services.

HOFr will use reasonable efforts to keep your personal information accurate and safe for the Identified purposes in accordance with applicable laws and best practices. You are responsible for informing HOFr about changes to your personal information. HOFr will update personal information, when necessary, to keep it accurate.

HOFr has instituted appropriate security measures that protect against the loss, misuse, alteration, or destruction of information that we have collected from users. HOFr requires that our vendors and service providers ensure the security of the data that you provide to them, however, in the event of a breach of their security measures, you agree that HOFr will not be liable for any loss of data or other damages to you.

HOFr limits access to personal information about users to employees for whom we reasonably believe it is necessary, in order to provide our Services to users.

HOFr has physical, electronic and procedural safeguards that comply with international regulations, to protect against the loss, misuse, alteration or destruction of information that we have collected from users.

HOFr has security measures and tools, such as firewalls, in place, to help protect against the loss, misuse, alteration and destruction of the information under our control. Unfortunately, no data transmission over the Internet or data storage system or email can be guaranteed to be 100% secure and error-free. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please notify us of the problem as soon as possible by sending an email to [email protected] or calling us at 1-888-669-2022.

UPDATING OR DELETING YOUR PERSONAL DATA

You may update or correct your Personal Data by editing your user account or by emailing us at [email protected].

If you wish to have your Personal Data deleted from our systems, you may email us at [email protected] or contact us at 1-888-669-2022. We will address your request, but we may be legally or otherwise required to keep such information in our archives and backup copies. We may also retain your information to prevent fraud, money laundering, or other unlawful activity or for similar purposes as required by applicable law.

You may stop all collection of information by uninstalling the App.

REVIEWING YOUR PERSONAL DATA

HOFr will afford you a reasonable opportunity to review the personal information we collect about you, in an understandable format, either by direct access or upon request to our customer services made by you, after providing sufficient identification.

If HOFr is not able to provide access to some aspect of your personal information, we will provide reasons for denying access such as: that by doing so would likely reveal personal information about a third party, or that it is confidential commercial information or attorney-client privileged communications, or that the information relates to a breach of an agreement or a contravention of law, or that its disclosure could reasonably be expected to threaten the life or security of another individual.

OPTING OUT FROM COMMUNICATIONS

HOFr gives you the option to remove your personally identifiable information from our list of active users.

You may also choose to opt-out of certain communications we will send you to promote our products and Services, or other products and services we feel may be of interest to you when you opt in for such communications upon registration or in your account settings.

At any time you may opt out from receiving such communications by clicking the unsubscribe link included in the email you receive or by emailing us at [email protected] or calling us at 1-888-669-2022.

HOFr is not responsible for removing your personally identifiable information from the lists of any third-party vendors and service providers who have previously been provided your information in accordance with this Privacy Policy.

Although you might opt out from marketing communications, we may send you service-related communications, including changes to our terms, conditions, and policies.

PUBLICLY POSTED INFORMATION

This Privacy Policy shall not apply to any information you post to the public areas of the Services.

CHILDREN AND MINORS

Use of HOFr Services is intended for persons who are eighteen (18) years or older. Depending upon your state of residence, the minimum age may be nineteen (19), twenty (20) or twenty-one (21) years.

HOFr does not knowingly collect Personal Data from individuals under the age of 18. HOFr’s Terms of Service require all account owners to be at least eighteen (18) years of age or the age of majority in their state of residence, whichever is older.

If proof comes to the attention of HOFr that a user is under the age of eighteen (18) years or or under the age of majority in their jurisdictions, HOFr will immediately terminate the account of such user.

THIRD PARTY WEBSITES AND APPLICATIONS

This Privacy Policy only applies to the Services. HOFr website and App may contain links to various third-party websites and mobile applications of our affiliates and/or third-party vendors and service providers (collectively “Third Party Sites”). We do not own, control or operate Third Party Sites, and we are not responsible for the privacy policies or practices of Third Party Sites. Privacy policies and practices for Third Party Sites may differ from our Privacy Policy and practices. We encourage you to read the privacy policies of Third Party Sites before disclosing Personal Data on Third Party Sites.

The only information that may be shared between HOFr and one of our partner or service provider websites is that which we tell you about, either through this Privacy Policy or through our Terms of Service.

CALIFORNIA PRIVACY RIGHTS

California residents have the right to opt out of disclosing personal information to third parties for marketing purposes as defined in the California Consumer Privacy Act (“CCPA”). We do not share your Personal Data with third parties for their own direct marketing purposes.

Under the CCPA, California residents have the following rights, which they can exercise directly or through an authorized agent:

If you wish to exercise your rights, we must be able to verify your identity as the owner of the account and personal data you are inquiring about before we can fulfill your request. You may designate an authorized agent to make the request on your behalf. The authorized representative must provide written evidence of your authorization to submit a request on your behalf.

Legitimate Interest. “Legitimate interests” means our interests in conducting our business, managing and delivering the best Services to you. This Privacy Policy describes when we process your Personal Data for our legitimate interests, what these interests are and your rights. We will not use your Personal Data for activities where the impact on you overrides our interests, unless we have your consent or those activities are otherwise required or permitted by law.
